Sydney Elements collects personal information for four reasons: to run the membership list, to answer your booking enquiry, to keep the venue safe, and to understand how this website is used. This policy sets out what we collect, why we hold it, who else sees it, where it goes, how long we keep it, and what you can do if you are not happy with any of that.
1. Who We Are
Sydney Elements is an adult nightclub at 42 Darlinghurst Road, Potts Point NSW 2011, operated by Sydney Elements Pty Ltd, ABN 35 680 341 619. In this policy, "we", "us" and "our" mean that entity.
This policy covers personal information we collect through this website, through the membership list, through the concierge and enquiry forms, through job applications, and at the venue itself.
We handle personal information in line with the Australian Privacy Act 1988 and the Australian Privacy Principles.
We are a licensed venue in Potts Point. This page explains what we know about you, why we know it, and what you can do about it.
2. What We Collect
What we hold depends on how you deal with us. We group it into five collections.
Members
If you join the membership list we hold the following.
| What | Why we hold it |
|---|---|
| Name | Addressing you, and recognising your booking at the door. |
| Email address | Your account identity. We sign you in with a one-time link rather than a password, so the email address is the account. |
| Phone number | Reservation follow-up and concierge callback. This field is optional. |
| Date of birth | Two purposes only: confirming you are 18 or over, and triggering the birthday offer. We never disclose it. |
| Membership tier | Which perks and members-only events apply to you. Tiers are set by staff. There is no automated profiling and no automated decision-making. |
| Marketing consent | Whether you have opted in, and the record of that choice. |
| Account dates and status | When you joined, whether your sign-in link has been used, and an audit trail. |
| Prize game activity | Enforcing one entry per period and recording what was won, if you play. |
People who make an enquiry or a reservation
You do not have to be a member to contact us. If you use the reservation form, the contact form or the concierge, we hold the name, phone number, email address and booking details you give us, along with what you asked about.
People who use the concierge chat
We hold the messages you send to the concierge and the answers it gives. Please do not type payment details, identification numbers or health information into the chat. It is a booking assistant, not a secure channel.
People who apply for a role
If you apply through our careers page we hold your name, contact details, availability, the experience and licences you tell us about, and anything you attach.
People who visit the venue
The venue operates closed-circuit television for the safety of guests and staff. Identification may be checked at the door to confirm you are 18 or over.
People who visit this website
We collect standard technical information: IP address, browser and device type, pages viewed, how you arrived, and how you moved through the site. Section 6 covers this in detail.
3. How We Collect It
Directly from you, when you fill in a form, join the membership list, apply for a role, message the concierge, call us or speak to staff at the venue.
Automatically, through cookies and the analytics tools described in section 6.
At the venue, through closed-circuit television and identification checks at the door.
Where it is lawful and practical to do so, you can deal with us anonymously or under a pseudonym. You do not have to join the membership list to visit, to book a booth or to ask a question. You cannot be anonymous where we are required to confirm your age.
4. Why We Collect It
We collect personal information to run the venue and the services you have asked for. Specifically, to operate your membership account and any gated member areas, to send the sign-in link and the welcome email, to apply your tier perks and the birthday offer, to answer your enquiry and confirm your booking, to consider your job application, to keep the venue and the people in it safe, to meet our obligations as a licensed venue, and to understand how this website is used so we can improve it.
We do not sell personal information. We do not trade it, rent it, or pass it to data brokers.
5. Marketing And How To Opt Out
We only send marketing where you have opted in. Your consent is recorded against your record, and every marketing message carries a working unsubscribe link, which is what the Spam Act 2003 requires.
Member communications are sent through Resend, the email service the venue uses, so unsubscribing takes effect there. You can also ask us directly using the contact details in section 17 and we will action it.
Transactional messages are different. If you hold an account we will still send you the sign-in link you requested and messages about a booking you made, because those are the service itself rather than marketing.
No opt-in, no marketing. Unsubscribe works, and we will do it by hand if you would rather email us.
6. Cookies And Analytics
This website uses two Google tools that collect information about your visit.
| Tool | What it does |
|---|---|
| Google Analytics 4 | Counts visits and shows which pages and sources bring people to the site. Aggregated reporting. |
| Google Search Console | Shows which search terms bring people here. Aggregated, never individual. |
We do not use session recording on this website. If we ever add it, we will name it here first and give you a way to switch it off.
Essential cookies keep the site working, including the one that keeps members signed in to the member area. You can block or delete cookies in your browser, though parts of the site may stop working properly.
7. Who We Share It With
We share personal information only where it is needed to run the service.
| Who | What for |
|---|---|
| Cloudflare | Website hosting, content delivery, and the member database. |
| Resend | Sending the sign-in link and the welcome email. |
| Sanity | Managing website content. Holds no member data. |
| Acuity Scheduling | Taking package bookings through the calendar on the packages page. |
| The analytics tools in section 6. | |
| The concierge provider | Generating concierge answers from your messages. |
| AMACCA Digital | Building and maintaining this website, under contract, with access limited to what maintenance requires. |
| Police, regulators and courts | Where we are required or authorised by law, including our obligations as a licensed venue. |
Staff access is limited to the people who need it to do their job.
8. Sending Information Overseas
Several of the providers in section 7 store or process information outside Australia, most often in the United States. That means Cloudflare, Resend, Google, Sanity, Acuity and the concierge provider.
Before disclosing personal information to an overseas recipient we take steps that are reasonable in the circumstances to ensure they handle it in a way consistent with the Australian Privacy Principles, principally through the contractual terms those providers offer.
The tools that run this site are mostly American. Your information reaches them, and we hold them to Australian standards by contract.
9. How We Keep It Safe
Information is encrypted in transit. The member database sits behind access controls and application credentials are held as platform secrets rather than in code. We use one-time sign-in links, so we never store a password for your account, which means there is no password of yours for anyone to steal from us.
Staff access is restricted to what each role requires.
We should be straight with you about the limit: no method of transmission over the internet and no method of electronic storage is completely secure. We take reasonable steps, and we cannot guarantee absolute security.
10. If Something Goes Wrong
If we suspect a data breach we assess it promptly, and within 30 days at the latest.
If the breach is likely to result in serious harm to anyone whose information is involved, we notify those people and the Office of the Australian Information Commissioner as soon as practicable. That is the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act, and we follow it.
Breach response is handled by venue management, using the contact details in section 17.
11. How Long We Keep It
We keep personal information only as long as we need it, then destroy it or de-identify it.
| What | How long |
|---|---|
| Member records | While your membership is active |
| Enquiries and reservations | 12 months |
| Concierge chat transcripts | 14 days |
| Job applications | 12 months |
| Prize game records | 28 days |
| CCTV footage | Only as long as it is needed for safety and security, then overwritten |
| Sign-in links | Single use and short-lived. Deleted as soon as they are used. |
| Marketing consent and unsubscribe records | Retained after an account is deleted, as evidence that consent was given or withdrawn. This is the one record that outlives the account, and it exists to protect you. |
12. Getting A Copy, And Correcting It
You can ask us for a copy of the personal information we hold about you, and you can ask us to correct anything that is wrong, out of date or incomplete. Use the contact details in section 17.
There is no charge for making a request. We may need to confirm who you are before we release anything, which usually means answering from the email address on the account. We respond within 30 days.
If we refuse access or refuse to correct something, we will tell you why in writing and explain how to complain.
Members can also ask us to delete their membership record entirely. The venue can export its member list at any time, because the audience belongs to the venue.
13. Complaints
If you think we have mishandled your personal information, here is the ladder.
- Tell us first. Write to our privacy contact in section 17. We acknowledge your complaint promptly and respond within 30 days.
- If you are not satisfied, complain to the Office of the Australian Information Commissioner. Visit oaic.gov.au, call 1300 363 992, or write to GPO Box 5218, Sydney NSW 2001.
- Note the order. The OAIC normally expects you to raise the matter with us first and to allow us 30 days to respond before it will take the complaint on.
14. People Under 18
This website and this venue are strictly for people aged 18 and over. We do not knowingly collect personal information from anyone under 18. If we become aware that we hold information about a minor, we delete it.
15. Links To Other Sites
This site links to Google Maps, Apple Maps, Instagram and TikTok, and will link to our booking provider. Once you follow a link you are on their site and their privacy policy applies, not ours. We are not responsible for how they handle your information.
16. Changes To This Policy
We update this policy when our practices change. The current version and its effective date are shown in the contents panel. Material changes will be flagged on this page.
Version 1.0. Effective on publication.
