Nothing here is an offer to sell, and no payment can be made through this website. Bookings are confirmed by the venue directly, and entry is always subject to the house rules and the door.
1. About These Terms
This website is operated by Sydney Elements Pty Ltd, ABN 35 680 341 619, trading as Sydney Elements, of 42 Darlinghurst Road, Potts Point NSW 2011.
These terms apply every time you use this website. If you do not accept them, please do not use the site.
2. Acceptance And The 18+ Requirement
This website is for people aged 18 and over. By passing the age confirmation and continuing to use the site, you confirm that you are 18 or over and that you accept these terms.
The age confirmation is a condition of use, not a formality.
3. What This Site Is, And Is Not
This website exists to give information about the venue and to let you make an enquiry.
No purchase or payment can be made through this website. Nothing on this site is an offer to sell. Prices, packages and offers shown are indicative and subject to change and availability. A confirmed package or booking is paid using the instructions in the confirmation email the venue sends. Anything else is paid at the venue.
4. Reservations And Enquiries
Submitting a booth request, a table request or any other enquiry is a request, not a confirmed booking. A booking exists only once the venue confirms it with you directly.
We may decline a request, and we may cancel a confirmed booking where we reasonably need to.
A confirmed package is paid by bank transfer within 3 days of the confirmation email, and a booking that is not paid in that time is cancelled. Any other payment or cancellation terms are set out in the confirmation email the venue sends you.
Entry always remains subject to our house rules and the door.
5. Membership
Membership is free and payment-free. It is granted at our discretion and may be suspended or withdrawn at our discretion.
Tiers are assigned by staff. Perks, tier names and members-only events may change, and we may add or remove them without notice.
Membership does not guarantee entry. The house rules and the door policy still apply to members, on every night.
You are responsible for keeping access to your email account secure, because sign-in links are sent there. Tell us promptly if you think someone else has access to your membership.
6. Promotions, Offers And Prizes
Drink specials, packages and promotions are subject to availability and may change or end without notice. The $8 pint and $4 half pint special is a rotating special, not a permanent price.
Any prize game we run is governed by its own terms, which will be published with the game, including how it is entered, what the prizes are and the chances of winning.
Prize games run in accordance with the New South Wales community gaming rules.
7. Accuracy Of Information
We take reasonable care to keep this site accurate, but events, line-ups, trading hours, prices and packages change, sometimes at short notice.
We do not warrant that the site is free of errors or that it will always be available. If something matters to your plans, call the venue on +61 429 201 971 and confirm it.
8. Imagery On This Site
Photographs of the venue on this website are real. Any person shown in our promotional imagery is illustrative and is not an actual member of staff, performer or guest.
The rooms, bars, stage, booths, private rooms and virtual tour are photographs taken at 42 Darlinghurst Road. Where a person appears in promotional imagery, that figure is illustrative and digitally created. It is not a photograph of anyone who works at or attends the venue, it is not a representation about any individual, and no person shown should be taken to be a member of staff, a performer or a guest. We do not photograph our performers for this website, so this is not a temporary arrangement.
The place you see is the real place. The people in our promotional imagery are not real people, and nobody shown is a performer you can ask for.
9. Intellectual Property
The content of this website, including text, images, graphics, logos and layout, is owned by Sydney Elements Pty Ltd or its licensors and is protected by copyright and other intellectual property laws.
You may view and print pages for your own personal, non-commercial use. You may not reproduce, republish, scrape or bulk-copy any part of this site without our written permission.
The Sydney Elements name, logo and brand marks are reserved.
10. Acceptable Use
You agree not to use this website to do anything unlawful, and not to interfere with it. That includes not attempting to gain unauthorised access to any part of the site or its systems, not introducing malicious code, not using automated tools to harvest content or personal information, and not submitting false details through any form.
11. Links To Other Sites
This site links to other websites including Google Maps, Apple Maps, Instagram, TikTok and our booking provider. Those sites are not under our control. We provide the links for convenience and we are not responsible for their content, their availability or their privacy practices.
12. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
Subject to that, and to the extent permitted by law, we are not liable for any loss or damage arising from your use of this website, from any inaccuracy in the information on it, or from the site being unavailable.
Where our liability cannot be excluded but can be limited, it is limited to resupplying the relevant service or paying the cost of having it resupplied.
13. Indemnity
You are responsible for your own conduct on this site and at the venue. Where you cause loss by breaching these terms or the house rules, you are responsible for that loss. Nothing in this clause limits your rights under the Australian Consumer Law.

15. Changes To These Terms
We may update these terms. The current version applies from the effective date shown in the contents panel, and using the site after that date means you accept the updated terms.
